The petitioner Atif Irshad Kumar (victim) had sought directions on the respondents including the Power Development Department (PDD), Hindustan Construction Company (HCC) and National Hydro Power Corporation. (NHPC) for providing him compensation for his permanent disability due to electric shock.

The petitioner, a six year old child of Mantrigam Bandipora, had filed a petition in the court through his counsel Advocate Bashir Ahmad Tak stating that in the year 2018, the petitioner had come in direct contact with a live 33000 KV HT line. He was playing with some metal object in the third floor of his house next to his residential house located at Mantrigam Bandipora.

The residential house was constructed in the year 2008 and 33000 KV HT line was laid by PDD to Kishan Ganga Power House constructed by NHPC with the help of HCC in 2012.

According to the petitioner the said HT line was deliberately installed in spite of the objections raised by the residents of the village including the victim’s father.

The petitioner suffered severe burns due to electric shock and lakhs of rupees were spent on medical expenses by his father. He was admitted to hospital in Srinagar and New Delhi without any help from Bandipora administration or PDD, HCC and NHPC.

The said victim was operated upon several times as a result of which she suffered burn injuries all over her body except thumb of right hand, thumb of left hand and toe of right foot. The disability of the aggrieved petitioner was assessed and assessed by the Medical Board to the extent of 90 per cent.

After hearing the arguments of the counsel for the petitioner and the counsel for PDD, HCC and NHPC, the court of Justice Javed Iqbal Wani observed that it is an admitted fact brought out from the pleadings of the parties that the victim petitioner has been electrocuted, which is 90 The percentage is done. disabled. He observed that the claim that the father of the aggrieved petitioner had constructed the third floor of his residential house near HT line in the year 2012, is not based on any evidence and there is no documentary evidence to support the same. In reference to various judgments of the Supreme Court, Justice Javed Iqbal Wani ordered the Respondents to pay an amount of Rs.30,20,000 (Thirty Lakh and Twenty Thousand Only) along with interest at the rate of 6 per cent per annum from the date of filing of the petition . By depositing in a fixed deposit account in the name of the aggrieved petitioner (minor) the aggrieved petitioner was presented as a natural guardian till the age of attainment of majority by the aggrieved petitioner in a nationalized form up to the date of actual deposit. The court further stated that the monthly interest earned on the amount of compensation during the period when the victim petitioner is a minor shall be withdrawn by the father of the victim petitioner and shall be spent on the victim petitioner as monthly expenses including treatment.
