The Delhi High Court on Thursday dismissed a petition opposing the permission for Sikhs to carry kirpans while traveling on civilian flights in India.

The petition, filed in the form of a public interest litigation (PIL) by advocate Harsh Vibhor Singhal, challenged the Centre’s notification issued on March 4, requiring Sikh commuters to carry blades not exceeding six inches in length and not exceeding the total length. was allowed. Nine inches while traveling anywhere in India.

On December 15, the High Court had reserved its order on the petition.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramaniam Prasad had said: “How can we interfere in such a policy decision? We cannot interfere. This is a policy decision of the Government of India.

The petitioner had claimed that a committee of stakeholders should be constituted to apply its mind on the issue.

On this, the court had said, ‘May be your mind is not the mind of the government. So when the government has applied its mind and come up with a policy, we should not interfere unless it is arbitrary.

The court had also declined to consider submissions by some of the parties as their applications were not on record.

The plaintiff had said that he was not questioning the rights of Sikhs, but wanted the stakeholders to examine the issue.

He had said: “I accept that Article 25 permits the carrying of a kirpan. But the regulator should apply its mind when you are flying. I want to set up a committee of stakeholders to look into this issue. If the committee feels that the notification is good, then it is fine. not a problem.”

Defending his argument, he argued that the Bureau of Civil Aviation Security did not formulate policy, but was only doing what the government said.

Advocate Anjana Gosain, representing the respondents, said, “Security measures, including deployment of marshals, have been put in place by the authorities.”

The court had on August 18 refused to pass an interim order allowing Sikhs to carry kirpans up to six inches in length on flights.
